Welcome to Akira Jewels. The terms “we,” “us,” and “our” refer to Akira Jewels, a sole proprietorship owned by Radhika Sukhija and operating in British Columbia, Canada.
Akira Jewels operates this website and online store, including the information, content, features, tools, products, and services made available through it collectively, the “Services.” Our online store is powered by Shopify.
These Terms of Service, together with the policies referenced below, describe your rights and responsibilities when using the Services. By visiting, browsing, interacting with, or purchasing from our website, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms or our Privacy Policy, please do not use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to accurately describe and display our products. Colours and appearance may vary because of lighting, photography, screen settings, and the device used to view the website.
Natural gemstones can vary in colour, clarity, shape, pattern, texture, and inclusions. These variations are part of the natural character of each stone and do not necessarily constitute a defect.
Some product photographs may be digitally styled, enhanced, or generated to illustrate the design, appearance, or scale of a piece. Customers should review the complete product description, measurements, materials, sizing information, and all available images before ordering. The actual natural stone may vary from the styled images.
Gemstone symbolism, meanings, or traditional associations presented on our website are provided for cultural, historical, or general-interest purposes. They are not medical, psychological, or professional health claims and should not replace professional advice or treatment.
We may update product descriptions, images, prices, specifications, or availability at any time. We may discontinue a product or limit the quantity available to a person, geographic region, or jurisdiction, subject to applicable law.
SECTION 3 — ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received the order. It does not necessarily mean that the order has been accepted or fulfilled.
We may accept, decline, limit, or cancel an order for reasons including unavailable inventory, suspected fraud, incorrect pricing, payment problems, shipping restrictions, or errors in product information. If we cancel an order after receiving payment, we will refund the affected amount.
Please review your order carefully before submitting it. If you need to request a change or cancellation, email us promptly at akirajewels111@gmail.com. We cannot guarantee that an order can be changed or cancelled after it has been accepted or prepared for shipment.
Products purchased through our online store are intended for personal or household use unless we agree otherwise in writing.
SECTION 4 — PRICES, TAXES, AND PAYMENT
Unless stated otherwise, all prices are shown in Canadian dollars.
Prices may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of an obvious pricing or technical error.
Applicable taxes and shipping charges are calculated and displayed during checkout. Promotions and discount codes may have separate terms, eligibility requirements, expiration dates, and exclusions.
You agree to provide accurate and authorized payment information. You represent that you have the authority to use the payment method supplied and that the payment provider will honour the charges associated with your purchase.
SECTION 5 — SHIPPING AND DELIVERY
Shipping options, charges, processing times, and delivery information are governed by our Shipping Policy:

Delivery dates and transit times are estimates. They may be affected by carriers, weather, service interruptions, address problems, peak seasons, or other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address. Contact us promptly if you notice an error. Address changes may not be possible after an order has been dispatched.
Nothing in these Terms limits any cancellation, refund, or other rights available under applicable consumer protection law.
SECTION 6 — RETURNS, REFUNDS, AND DAMAGED ITEMS

If an item arrives damaged or you receive the wrong item, contact us as soon as possible at akirajewels111@gmail.com with your order number and photographs of the item and packaging.
Our policies do not limit any rights or remedies that cannot be excluded under applicable consumer protection law.
SECTION 7 — PRODUCT AVAILABILITY
Many Akira Jewels pieces are available in limited quantities. Adding a product to a cart does not reserve it.
If a product becomes unavailable after an order is placed, we may contact you to arrange a replacement, provide another available option, or refund the unavailable item.
Inventory information may occasionally be delayed or inaccurate because of technical issues, simultaneous orders, or sales occurring through another authorized Akira Jewels channel.
SECTION 8 — INTELLECTUAL PROPERTY
The Services and their content—including the Akira Jewels name, branding, logos, text, product descriptions, photographs, graphics, illustrations, videos, audio, layouts, and designs—are owned by or licensed to Akira Jewels and are protected by Canadian and international copyright, trademark, and other applicable intellectual property laws.
You may use the website for personal and non-commercial shopping purposes. You may not reproduce, distribute, modify, republish, sell, exploit, publicly display, or create derivative works from our content without prior written permission.
Shopify’s name, logos, products, and services are the property of Shopify. Other names and trademarks displayed through the Services belong to their respective owners.
SECTION 9 — CUSTOMER REVIEWS AND FEEDBACK
If you voluntarily provide a review, photograph, testimonial, suggestion, or other feedback, you confirm that you have the right to provide it and that it is truthful and does not violate another person’s rights.
You grant Akira Jewels a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish, and display that feedback for operating, improving, and promoting our business and Services.
You must disclose any payment, discount, free product, or other incentive connected with a review or testimonial.
We may remove content that is unlawful, misleading, abusive, defamatory, obscene, infringing, fraudulent, or otherwise inappropriate.

Akira Jewels is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Akira Jewels.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Akira Jewels, including any injury, damage, or loss resulting from purchased products or services. To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Akira Jewels.

To the extent permitted by applicable law, you agree to indemnify Akira Jewels and its service providers against third-party claims, losses, or reasonable legal costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights.
This section does not require you to indemnify Akira Jewels for our own negligence, unlawful conduct, or breach of these Terms.

You may stop using the Services at any time.
We may restrict, suspend, or terminate access to the Services if you materially violate these Terms, misuse the Services, engage in suspected fraud, or create a security or legal risk.
Termination does not affect rights or obligations that arose before termination. Provisions that are intended by their nature to survive termination will continue to apply.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

A failure by Akira Jewels to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms and the policies referenced in them form the agreement between you and Akira Jewels regarding your use of the Services and replace prior communications relating to the same subject.
Nothing in this section limits representations, warranties, rights, or remedies that cannot be excluded under applicable law.
SECTION 21 — ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent.
We may transfer our rights and obligations as part of a sale, reorganization, transfer, or restructuring of the business, subject to applicable law.
SECTION 22 — GOVERNING LAW
These Terms and any separate agreements through which we provide the Services are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Subject to any rights available under applicable consumer protection law, you and Akira Jewels agree that the courts of British Columbia will have jurisdiction over disputes arising from these Terms or the Services.

We may update these Terms by publishing a revised version on this page.
Where required by law, we will provide notice of material changes. The updated Terms will take effect on the date stated in the revised version. Changes will not reduce rights that have already arisen under an accepted order unless permitted by law.
